TheraThere Terms of Service

1. The service
TheraThere provides scheduling, caseload and compliance-tracking software for ABA clinics and therapy practices (the “Service”). Each clinic (“Customer”, “you”) is a separate tenant: your data is isolated from every other clinic.
2. Trials and billing
New clinics start with a 14-day free trial. When the trial ends the account becomes read-only until a paid subscription is started. Paid plans are billed per active location per month. Failed payments enter a grace window before the account becomes read-only.
3. Protected Health Information
The Service may store Protected Health Information (PHI) as defined by HIPAA. As a Customer you are the Covered Entity (or a Business Associate of one) and TheraThere acts as your Business Associate. The relationship between the parties with respect to PHI is governed by the Business Associate Agreement, which is incorporated into these Terms by reference.
4. Your responsibilities
You are responsible for the accuracy of the data you enter, for maintaining the confidentiality of user credentials, for assigning appropriate roles to your staff, and for ensuring your use of the Service complies with HIPAA and other applicable law.
5. Termination and your data
You may cancel at any time. On termination, on request we will return your clinic's data in a machine-readable export and then delete it within 30 days, except where retention is required by law. See the Business Associate Agreement for PHI-specific handling.
6. Liability
The Service is provided “as is”. To the maximum extent permitted by law, TheraThere's aggregate liability is limited to the amounts you paid in the twelve months preceding the claim. This section is a placeholder pending legal review.
